The victim had been assigned to work on the roof of a new building that was still under construction. At the end of the workday, he attempted to descend the ladder that allowed access to the roof. While making his way down, the ladder slipped out from under him; as the ladder fell, the worker fell with it. He landed on the ground and attempted to brace himself against the impact with his heel and arm.

The injuries he subsequently sustained included a fractured left wrist and a fractured right calcareous. He had to undergo surgery for his wrist, which resulted in severe scarring and loss of motion. The defendant was not convinced that the victim was suffering from RSD, and even went as far as to follow him around and film him engaging in "normal activities."

While waiting for a verdict to be returned at trial, the victim agreed to the settle the case for $950,000.00, as the defendant only had a million dollar policy.
