What You Should Do If You Are Hit by a Drunk Driver in New York City

While the end result of a car accident caused by a drunk driver could be the same as a collision caused by a sober driver, the events leading up to the crash will be quite different. In order to improve your chances of receiving maximized compensation at the end of your subsequent injury claim or lawsuit, you will need to focus on these differences to some extent. In particular, how you react after being in a car accident with a drunk driver will be of utmost importance.

After being struck by an intoxicated motorist, behave as you would in any other car accident but be sure to also:

  • Call the police: Only the police can legally remove a dangerous driver from the road. No matter what the intoxicated driver says or insists, they should not be permitted to continue driving that night. Getting law enforcement to the scene as fast as possible should be a top priority to protect others from being hit as well.
  • Maintain a safe distance: You will need to exchange insurance and identifying information with the other driver but you might want to do this only after the police arrive. Some people become highly erratic or even violent when intoxicated. Causing a car accident will likely only further excite or incite these types of people. If you do not feel like the drunk driver is emotionally stable, you should respectfully stay at a distance or within your vehicle if it is safe to do so.
  • Get the BAC report: Assuming that you did get the police to the scene of your car accident, the drunk driver should have been tested at one point or another for a blood alcohol concentration (BAC) level test. You need a copy of the BAC result to improve the validity of your claim. This might not be available right away, though. In many cases, a car accident lawyer is actually the one who speaks with law enforcement at a later date to get a copy of the report.
